6-Month Membership Contract
Membership Agreement between Member, and DUTY TO ACT LLC doing business as, and referred to within this contract as, ABLE SHEPHERD, is for an agreed minimum of 6 months, followed by a month-to-month basis of monthly membership dues of $175 or upfront dues of $1050. This entitles member to, two (2) ABLE SHEPHERD Classes and one (1) MIX per month WHICH DO NOT ROLL OVER. It is the responsibility of the member to register and attend their entitled classes every month as dues are non-refundable. Registration for the monthly MIX is first come, first served and it is the responsibility of the member to register early to ensure a seat. Member may only attend Course classes within the phase of training that they have qualified for and below, but not above.
Member agrees to keep and obey all rules and regulations now in force or in the future prescribed by ABLE SHEPHERD, for the use of ABLE SHEPHERD, training facilities, premises, and equipment therein, and ABLE SHEPHERD reserves the right to revoke this membership for cause if Member fails to keep and obey any of such rules and regulations, or for reasons of nuisance, disturbance or other members or staff, moral turpitude or fraud. Without limiting Member’s obligation to obey the rules and regulations of ABLE SHEPHERD presently in force or in the future prescribed, Member agrees that he will obey the following rules by:
- a) Always considering other members’ safety, rights and privileges while he/she is training;
- b) Always paying his/her membership dues on or before the fifth of each month;
- c) Always printing his/her first and last names legibly on the sign-in sheet when attending classes;
- d) Always leave facility better than they found it;
- e) Always following the Range Rules and ALL safety rules presented in initial and ongoing training, and asking for direction when not 100 percent clear during any evolution;
- f) Never using foul or vulgar language;
- g) Always disposing of trash in the proper places;
- h) Always treating members and staff with fullest respect and courtesy at all times;
Without limiting ABLE SHEPHERD’s ability to terminate this membership for cause, ABLE SHEPHERD may terminate membership for any reason at the end of any given month. If ABLE SHEPHERD elects to so terminate, ABLE SHEPHERD will refund a pro rata portion of any dues applicable to current or future month(s).
It is expressly understood and agreed that the contract is not assignable or transferrable by Member and no classes, rights or privileges granted by the membership can be transferred or assigned by Member. EXAMPLE: member cannot give their credits to another person/member.
It is further agreed that all training including the use of firearms, all machinery, equipment, and apparatus designed for training and the use of ABLE SHEPHERD premises and facilities shall be at the Member’s sole risk. Notwithstanding any consultation on training programs which may be provided ABLE SHEPHERD employees or agents, it is hereby understood that the selection of training programs, methods and types of equipment shall be Member’s entire responsibility, and ABLE SHEPHERD shall not be liable to Member or Member’s family for any claims, demands, injuries, damages, or actions arising due to injury to Member’s person or property arising out of or in connection with the use by Member of the services and facilities of ABLE SHEPHERD or the premises where the same is located. If Member brings any personal property onto the premises of ABLE SHEPHERD or onto ABLE SHEPHERD’s parking area, Member takes such action at Member’s sole risk. It is hereby understood that ABLE SHEPHERD is not responsible in any way for damage to or loss of any personal property which Member brings onto the premises of ABLE SHEPHERD or onto ABLE SHEPHERD’s parking area, including but not limited to, losses due to theft, damage, or car accident. Member hereby holds ABLE SHEPHERD, its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by Member, on Member’s behalf, by Member’s family, and Member’s executors, administrators, and personal representatives for any such injuries or claims aforesaid and Member for himself and on behalf or his family, executors, administrators, and personal representatives does hereby forever release and discharge ABLE SHEPHERD, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. This section will survive any cancellation of this Agreement.
IF YOU DECIDE YOU DO NOT WISH TO REMAIN A MEMBER OF ABLE SHEPHERD, TO CANCEL WITH OUT PENALTY YOU MUST CONTACT ABLE SHEPHERD WITHIN 30 DAYS OF YOUR NEXT SCHEDULED AUTO DRAW BY EMAILING INFO@ABLESHEPHERD.COM PLEASE STATE YOUR DESIRE TO CANCEL THIS CONTRACT.
IF ABLE SHEPHERD GOES OUT OF BUSINESS AND DOES NOT PROVIDE FACILITIES WITHIN 10 MILES OF THE FACILITY IN WHICH YOU ARE ENROLLED OR IF ABLE SHEPHERD MOVES MORE THAN 10 MILES FROM THE FACILITY IN WHICH YOU ARE ENROLLED, YOU MAY CANCEL THE CONTRACT BY EMAILING (WITHOUT PENALTY) A NOTICE TO ABLE SHEPHERD STATING YOUR DESIRE TO CANCEL THE CONTRACT, ACCOMPANIED BY PROOF OF PAYMENT ON THE CONTRACT.
IF YOU DIE OR BECOME TOTALLY AND PERMANENTLY DISABLED AFTER THE DATE THE CONTRACT TAKES EFFECT, YOU OR YOUR ESTATE MAY CANCEL THE CONTRACT AND RECEIVE A PARTIAL REFUND OF YOUR UNUSED MEMBERSHIP FEE BY MAILING A NOTICE TO ABLE SHEPHERD STATING YOUR DESIRE TO CANCEL THE CONTRACT. ABLE SHEPHERD MAY REQUIRE PROOF OF DISABILITY OR DEATH. THE WRITTEN NOTICE MUST BE MAILED BY CERTIFIED MAIL.

Due to the high interest in taking this class; we ask for 72-hour cancellation for a FULL refund of the purchased price of $200.
If cancellation of the class is outside of the 72-hour window there will be a $15 admin fee for rebooking to another class date.
Rebooking to another class at a later date will need to be completed within 7 days of original scheduled class date or fees are forfeit.
If you wish for a refund outside of the 72-hour window there will be a 5% admin fee for credit card refunds.

We ask that you provide us with 24 hours’ notice of cancelling / reschedule of scheduled training classes.
Classes not canceled with 24 notice will forfeit the monthly credit or paid fee. This allows us to give other members option to get into classes that are full.
Membership Credits do not roll over monthly
Event Cancellation Policy
Due to planning and facility requirements, we ask for a 3 week cancelation for a FULL refund.
Event cancellations minimum ask of 72-hour notice and are subject to 50% refund maximum.
Events canceled/rebooked outside the 72-hour window are subject to a 5% cancellation fee or $15 rebooking admin free.
Event cancellation / no-show will forfeit paid fee.

All credit card transactions will result in a 5% admin fee for refunds. For all credit card refunds please allow for 3-5 business days to reflect on your statements.
Refunds can be issued by check and mailed to member at no fee. Please allow 7-10 business for all check refunds.

Able Shepherd is an elite self-defense training program utilizing armed, and unarmed tactics. Graduates become known as “Able Shepherds,” entrusted with skills to empower them to actively protect, guide, and strengthen their communities. Our goal is to make them, and those around them, safer. We do this by holding them to the highest of moral, ethical, and tactical standards.

Protect the Brand

- Do not agitate a volatile situation.
- Do not wear branded clothing to politically-inspired or any non-sanctioned events.
- Speak intelligently ABOUT the program, but not ON BEHALF of the program.
- Only the Public Relations officer for Able Shepherd will make statements ON BEHALF of Able Shepherd.
Sanctioned Events
On occasion Able Shepherd will coordinate volunteer personnel at events to enhance safety. These events are originated and coordinated by the Able Shepherd management team. Planning, staffing, organization, and dress code will be assigned during these events.
Non-Sanctioned Events
Events not coordinated by the Able Shepherd management team. Any Able Shepherd branding is inappropriate at these events.
Violating any of these policies may result in being removed from the training program.
Privacy Policy
We believe in your right to privacy and in keeping your confidential information confidential. With this in mind, we have adopted the online privacy policy described below.
Information Collection, Use, and Sharing
We only collect personal information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.
We request personal information from you when you sign up for any of our Services, including our newsletter. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.
We will also use your personal information to deliver our newsletter to you, interact with you by email or social media, and respond to you regarding the reason you contacted us. We will not share your personal information with any third party outside of our organization, other than as necessary to provide the Services (e.g. we may share your data with our payment processor in order to process your order).

We ask that you wear your mask at all times while in the training center for the safety of yourself and the instructors. While you are shooting LIVE fire, you may remove your mask only during these times to reduce “fogging” to your eye wear. Once shooting is complete or finished we ask that you put your mask back on.

July 17, 2020 Colorado Executive Order
We are following the Colorado Executive Order regarding COVID-19 Safety. The order goes into effect at midnight on July 17, 2020.
Gov. Jared Polis’ executive order requires all people, over the age of 10, to wear masks when in public indoor spaces in Colorado.

June 13, 2020 COVID-19 Pandemic Update
We are committed to health and safety of our members. We have downsized our classes to 8 people in each class. We are asking members to monitor their own symptoms and not come to class if not feeling well or feverish. We sterilize equipment after every use. Masks are optional. Instructors are being asked to take their temperature prior to coming into class.
Class credits from the shutdown (March/April) need to be scheduled through our admin office. Please call or email your requests for your 3rd class credit.
